2.         Discussion of issues related to the Neal Cearley lawsuit.  At least part of the discussion will        involve a private consultation with the commissioners court’s legal counsel pursuant to Tex.          Gov. Code Ann. Section 551.071 permitting a governmental body to conduct a private      consultation with its attorneys about pending litigation or settlement offers.  Take any           necessary action.  (TW)

           

 3.        Choose three additional members of the Randall County Salary Grievance Committee.  (TW)

 

4.         Receive recommendations from Randall County Courthouse Security Committee.  Take any      necessary action.  (Sheriff)           

 

 5.        Discuss and act on request to approve contract with Time America, Inc. for time and     attendance system.  (Auditor)

 

6.         Discuss and act on proposal to approve Memorandum of Understanding (MOU) with Potter     County regarding fire protection in the northwest corner of Randall County.  Discuss and act on future intentions with regard to fire protection in this area.  (TW)

 

7.         Discuss issues concerning a fire protection contract with the City of Amarillo.  (TW)

 

8.         Review of correspondence with the commissioners court.  (TW)

 

9.         Accept official reports.  (TW)

 

10.       Discuss and act on Randall County employees' requests to attend meetings and conferences.      (Auditor)

Motion was made by Commissioner Gualtiere.  So moved.

SECOND was made by Commissioner Huskey.

AYES: All five.

NAYS: None.

Motion carried by 5-0 vote.                                                                                                     

 

2.         DISCUSSION OF ISSUES RELATED TO THE NEAL CEARLEY LAWSUIT.  AT LEAST PART OF THE DISCUSSION WILL INVOLVE A PRIVATE CONSULTATION WITH THE COMMISSIONERS COURT’S LEGAL COUNSEL PURSUANT TO TEX. GOV. CODE ANN. SECTION 551.071 PERMITTING A GOVERNMENTAL BODY TO CONDUCT A PRIVATE CONSULTATION WITH ITS ATTORNEYS ABOUT PENDING LITIGATION OR SETTLEMENT OFFERS.  TAKE ANY  NECESSARY ACTION.  (TW)

 

Motion was made by Commissioner Huskey.  Motion that we refer some questions related to the Insurance Policy in this case to the District Attorney’s Office.

SECOND was made by Commissioner Parker.

3.         CHOOSE THREE ADDITIONAL MEMBERS OF THE RANDALL COUNTY SALARY GRIEVANCE COMMITTEE.  (TW)

4.         RECEIVE RECOMMENDATIONS FROM RANDALL COUNTY COURTHOUSE SECURITY COMMITTEE.  TAKE ANY NECESSARY ACTION.  (SHERIFF)

 

Motion was made by Commissioner Gualtiere.  Motion to move forward with hiring the personnel for the Courthouse Security, with $27,987.06 being taken out of the Courthouse Security budget, this includes related equipment needed for personnel.

SECOND was made by Commissioner Parker.

Motion was made by Commissioner Gualtiere.  Motion to ask the Sheriff’s Office to purchase the equipment stated in the middle box with a limit of $10,000.00.  (see exhibit)

SECOND was made by Judge Wood.

AYES: Four.

NAYS: One.  Huskey.

Motion carried by 4-1 vote.

 

Motion was made by Commissioner Karrh.  Motion to make recommendation that this Committee also bring a recommendation back on the moving of DPS into the 1st floor of the Justice Building, and if DPS is willing to respond to the County’s Panic buttons.

SECOND was made by Commissioner Huskey.

AYES: All five.

5.         DISCUSS AND ACT ON REQUEST TO APPROVE CONTRACT WITH TIME AMERICA, INC. FOR TIME AND ATTENDANCE SYSTEM.  (AUDITOR)

 

Motion was made by Commissioner Huskey.  Motion that we approve the contract with Time America as we have worked out the details since the last meeting.

SECOND was made by Commissioner Gualtiere.

6.         DISCUSS AND ACT ON PROPOSAL TO APPROVE MEMORANDUM OF UNDERSTANDING (MOU) WITH POTTER COUNTY REGARDING FIRE PROTECTION IN THE NORTHWEST CORNER OF RANDALL COUNTY.  DISCUSS AND ACT ON FUTURE INTENTIONS WITH REGARD TO FIRE PROTECTION IN THIS AREA.  (TW)

 

Motion was made by Commissioner Gualtiere.  Motion to approve the Short Term Memorandum of Understanding with Potter County.

SECOND was made by Commissioner Karrh.

Motion was made by Commissioner Gualtiere.  Motion to approve the Statement of Intention of Randall County in response to the Long Term Memorandum of Understanding with Potter County.

SECOND was made by Commissioner Parker.

7.         DISCUSS ISSUES CONCERNING A FIRE PROTECTION CONTRACT WITH THE CITY OF AMARILLO.  (TW)

 

Motion was made by Commissioner Parker.  Motion to table this until the 19th.

SECOND was made by Judge Wood.

NAYS: None.

Motion carried by 5-0 vote.                                                                                                     

 

8.         REVIEW OF CORRESPONDENCE WITH THE COMMISSIONERS COURT.  (TW)

 

Motion was made by Commissioner Gualtiere.  Motion to approve the correspondence with Commissioners Court.

SECOND was made by Commissioner Huskey.

SECOND was made by Commissioner Gualtiere.

Judge Wood adjourned the Randall County Commissioners Court until 2:00 p.m. Tuesday, March 5, 2002 in the Randall County Square North Courtroom.

At the meeting on March 5, 2002, Commissioner  Parker  moved to approve the minutes for the meeting held on the 26th of February 2002 as distributed.  Commissioner Huskey seconded the motion.   Five (5)  Voted aye.  The said minutes were approved as distributed and  No  correction was made in open Court.
