Be it remembered on this the 17th day of July 2001, there came to and was held a Regular Meeting at 3:30 p.m. of the Commissioners= Court in and for Randall County, Texas with the following present and presiding:

 

Theodore Wood,            Presiding County Judge

1.         Discuss and approve the minutes of the July 10, 2001 commissioners court meeting.  (TW)

 

2.         Discuss and act on request by general contractor on the new jail for Randall County to pay   one-half of the retainage that has been held to date and for Randall County to retain only             five percent instead of ten percent of all future payments.  (TW)                        

 

3.         Discuss issues of concern related to construction of the new jail.  Take any necessary action.  (TW) 

 

4.         Discuss the dates and times that budget discussions will be held.  Take any necessary             action.              (TW)   

             

5.         Discuss and act on proposal to approve “Memorandum of Understanding Between Randall             County, Texas” and The United States of Department of Energy”, in regard to firefighting             activities.  (TW)

 

6.         Discuss and act on request to approve a particular page of a Lease/Purchase Agreement and             corresponding resolution with Government Capital Corporation that the commissioners             court declined to approve on June 26.  (TW)

 

7.         Discuss and act on proposal to approve formal written contract with West Texas A & M             University, Government Administrative Study Group, for fire district study.  (TW)

 

8.         Review of correspondence with the commissioners court.  (TW)

 

9.         Accept official reports.  (TW)

 

10.       Discuss and act on Randall County employees' requests to attend meetings and conferences.              (Auditor)

 

11.            Approval of vouchers.  (Auditor)

1.            DISCUSS AND APPROVE THE MINUTES OF THE JULY 10, 2001 COMMISSIONERS COURT MEETING.  (TW)

 

Motion was made by Commissioner Gualtiere.  Motion to approve the minutes of the July 10, 2001 Commissioners Court meeting.

SECOND was made by Commissioner Huskey.

AYES: All five.

NAYS: None.

Motion carried by 5-0 vote.                                                                                                                

 

2.            DISCUSS AND ACT ON REQUEST BY GENERAL CONTRACTOR ON THE NEW JAIL FOR RANDALL COUNTY TO PAY             ONE-HALF OF THE RETAINAGE THAT HAS BEEN HELD TO DATE AND FOR RANDALL COUNTY TO RETAIN ONLY FIVE PERCENT INSTEAD OF TEN PERCENT OF ALL FUTURE PAYMENTS.  (TW)

 

Motion was made by Commissioner Karrh.  Move that we accept the proposal.

SECOND was made by Commissioner Parker.

AYES: Two.  Parker, Karrh.                                                                          Exhibit 1

NAYS: Three.  Gualtiere, Wood, Huskey.                                                            Resolution #2001-94

Motion failed by 2-3 vote.                                        

 

MOTION was made by Commissioner Huskey.  Motion that we authorize payment of the General Contractor one half of the retainage of everything held through June 30th, but that we continue to retain 10% of the remaining items between July 1st to the end of the project.

SECOND was made by Judge Wood. 

AYES:  Four.

NAYS:  None.

ABSTAINING:  One.  Parker.

Motion carried by 4-0-1 vote.                                                                                                             

 

3.            DISCUSS ISSUES OF CONCERN RELATED TO CONSTRUCTION OF THE NEW JAIL.  TAKE ANY NECESSARY ACTION.  (TW) 

 

No action taken.                                                                                                                          

 

4.            DISCUSS THE DATES AND TIMES THAT BUDGET DISCUSSIONS WILL BE HELD.  TAKE ANY NECESSARY             ACTION.              (TW)

5.            DISCUSS AND ACT ON PROPOSAL TO APPROVE “MEMORANDUM OF UNDERSTANDING BETWEEN RANDALL COUNTY, TEXAS” AND THE UNITED STATES OF DEPARTMENT OF ENERGY”, IN REGARD TO FIREFIGHTING ACTIVITIES.  (TW)

 

Motion was made by Commissioner Parker.  Motion that we approve the Memorandum of Understanding between Randall County Texas and the United States Department of Energy, in regard to firefighting activities

6.            DISCUSS AND ACT ON REQUEST TO APPROVE A PARTICULAR PAGE OF A LEASE/PURCHASE AGREEMENT AND CORRESPONDING RESOLUTION WITH GOVERNMENT CAPITAL CORPORATION THAT THE COMMISSIONERS             COURT DECLINED TO APPROVE ON JUNE 26.  (TW)

 

Motion was made by Judge Wood.  Motion that we table the issue for one week.

SECOND was made by Commissioner Gualtiere.

AYES: All five.

NAYS: None.

Motion carried by 5-0 vote.                                                                                                                

 

7.            DISCUSS AND ACT ON PROPOSAL TO APPROVE FORMAL WRITTEN CONTRACT WITH WEST TEXAS A & M UNIVERSITY, GOVERNMENT ADMINISTRATIVE STUDY GROUP, FOR FIRE DISTRICT STUDY.  (TW)

 

Motion was made by Commissioner Huskey.  Motion that we notify the appropriate people at WT that we are going to go through a budget process and if the study makes the budget, we will obviously need to forego the time and the deadlines on the contract, but until we go through that process that we are unwilling to sign a contract that we don’t know that we can fund.

SECOND was made by Commissioner Gualtiere.

AYES: Four.

NAYS: One.  Wood.

Motion carried by 4-1 vote.                                                                                                                

 

8.            REVIEW OF CORRESPONDENCE WITH THE COMMISSIONERS COURT.  (TW)

 

Motion was made by Judge Wood.  Move that we accept the correspondence with Commissioners Court.

SECOND was made by Commissioner Huskey.

9.            ACCEPT OFFICIAL REPORTS.  (TW)

 

Motion was made by Commissioner Gualtiere.  Motion to accept the Official Reports.

10.            DISCUSS AND ACT ON RANDALL COUNTY EMPLOYEES' REQUESTS TO ATTEND MEETINGS AND CONFERENCES.  (AUDITOR)

 

Motion was made by Commissioner Gualtiere.  Motion to approve the Randall County Employees request to attend meetings and conferences.

SECOND was made by Commissioner Huskey.

Motion carried by 5-0 vote.                                                                                                                

 

11.            APPROVAL OF VOUCHERS.  (AUDITOR)

 

Motion was made by Commissioner Huskey.  Move the following checks be approved for payment.

SECOND was made by Commissioner Gualtiere.

Judge Wood adjourned the Randall County Commissioners Court until 3:30 p.m. Tuesday, July 24th  2001 in the Randall County Square North Courtroom.

At the meeting on July 24, 2001, Commissioner Gualtiere   moved to approve the minutes for the meeting held on the 17th of July 2001 as distributed.  Commissioner Huskey  seconded the motion.   Five (5)  Voted aye.  The said minutes were approved as distributed and  No  correction was made in open Court.
