Be it remembered on this the 16th day of November 2000, there came to and was held a Emergency Meeting at 2:00 p.m. of the Commissioners= Court in and for Randall County, Texas with the following present and presiding:
Theodore Wood, Presiding County Judge
Robert Karrh Commissioner Precinct 1
Gene Parker, Commissioner Precinct 2
George Huskey, Commissioner Precinct 3 Absent
Craig Gualtiere, Commissioner Precinct 4
Also present at the meeting was Sue Wicker Bartolino, County Clerk.

1. Accept petition signatures from Carol Autry, Randall County Tax Assessor/Collector.
Discuss and act on proposal to hire an outside accounting firm to check signatures on rollback petition. Take any other necessary action in regard to the rollback petition.
This emergency meeting will be held pursuant to Texas Government Code Annotated Section 551.045 (Vernon 1994), which allows for an emergency meeting when there is an emergency or an urgent public necessity. In this case, an urgent public necessity exists because immediate action by the Randall County Commissioners Court is required because of a reasonably unforeseeable situation. Specifically, the reasonably unforeseeable situation is that the commissioners court needs to pass on the validity of a rollback petition by December 4, 2000. It is advisable to have an independent third party check the petitions and adequate time must be given to the third party to check the signatures. Absent immediate action, there may not be enough time for proper petition validation.

1. ACCEPT PETITION SIGNATURES FROM CAROL AUTRY, RANDALL COUNTY TAX ASSESSOR/COLLECTOR. DISCUSS AND ACT ON PROPOSAL TO HIRE AN OUTSIDE ACCOUNTING FIRM TO CHECK SIGNATURES ON ROLLBACK PETITION. TAKE ANY OTHER NECESSARY ACTION IN REGARD TO THE ROLLBACK PETITION.
Motion was made by Commissioner Gualtiere. Motion to accept the petition back from Carol Autry's office unto the Commissioners' Court.
SECOND was made by Commissioner Parker.
AYES: Four.
NAYS: None.
Motion carried by 4-0 vote.
Motion was made by Judge Wood. Motion to accept these requirements for valid petition signatures to send to our accounting firm with one change on the first paragraph, on the second page, the third sentence, where it says a handwriting expert from the D.A.'s office will determine whether the signatures were made by the same person. I would eliminate that from the instructions. With oral instructions that we ask them to go thru the list in such a way that they come up with the signatures that are in their mind unquestionably valid and if they reach the magic number they are done, as opposed to saying - spend a lot of time on the first questionable one they come to.

Motion carried by 4-0 vote.
Motion was made by Judge Wood. Motion that we do hire Brown Graham & Co. to be the accounting firm involved and that we contract with them to pay for this service at the rate of $30 per hour.
SECOND was made by Commissioner Gualtiere.
AYES: Four.
NAYS: None. Resolution #2000-183
Motion carried by 4-0 vote.
Motion was made by Judge Wood. Motion is that we indicate our intention to allow a supplemental petition up to the date of December 11, 2000.
SECOND was made by Commissioner Gualtiere.
AYES: Two. Wood, Gualtiere.
NAYS: Two. Parker, Karrh.
Motion failed by 2-2 vote.
Motion was made by Commissioner Gualtiere. Motion that we give the final deadline to the Accounting Firm of 20 days, with the understanding that we would like them to finish their work ASAP.
SECOND was made by Commissioner Parker.
AYES: Three.
NAYS: One. Wood.
Motion carried by 3-1 vote.
Motion was made by Judge Wood. Motion that we instruct Dave Thurman to remove the sticky notes and give just the raw materials to the Accounting Firm and that he do so when I direct you to physically carry them over there.
SECOND was made by Commissioner Karrh.
AYES: Four.
NAYS: None.
Motion carried by 4-0 vote.

Judge Wood adjourned the Randall County Commissioners Court until 9:00 am. Tuesday, November 21st, 2000 in the Randall County Square North Courtroom.

At the meeting on November 21, 2000, Commissioner Karrh moved to approve the minutes for the meeting held on the 16th of November 2000 as distributed. Commissioner Gualtiere seconded the motion. Five (5) Voted aye. The said minutes were approved as distributed and No correction was made in open Court.
